Terms of Service

1. Acceptance

By creating an account or using the DataKubo platform, you agree to these Terms of Service. If you are using DataKubo on behalf of a company, you represent that you have authority to bind that company to these terms.

2. The Service

DataKubo provides a white-label IoT enablement platform for solution providers (resellers). The platform includes device data ingestion, dashboards, customer management, and API access. We are infrastructure — resellers build their own services on top of DataKubo and are responsible for their customer relationships.

3. Accounts & Access

• You must provide accurate information when creating an account
• You are responsible for keeping your API key and credentials secure
• You may not share your account or API key with unauthorized parties
• You must notify us immediately of any unauthorized access

4. Subscriptions & Billing

Subscriptions are billed monthly. Pricing is based on your tier and active device count. Current pricing is available on our pricing page. Early adopter rates are locked for life for qualifying accounts.

Payments are processed securely. Subscriptions renew automatically. You may cancel at any time with 30 days notice. No refunds for partial months.

5. Acceptable Use

You may not use DataKubo to:

• Violate any applicable laws or regulations
• Transmit malicious code or interfere with platform operations
• Attempt to access other resellers' data
• Exceed rate limits in a way that degrades service for others
• Resell or sublicense the platform itself (you may build services on top of it)

6. API Usage & Rate Limits

Webhook ingestion is limited to 100,000 requests per month per reseller account. Dashboard API calls are unlimited. Exceeding the webhook limit returns a 429 response. Limits reset on the first of each month.

7. Data & Ownership

You own all data you and your customers generate on the platform. DataKubo stores it on your behalf. We may use anonymized, aggregated data to improve the platform. We will never contact your customers or share your data with other resellers. You may export your data at any time.

8. Non-Compete Commitment

DataKubo will not sell directly to your customers, market to them, or compete with you in your market. We are infrastructure — your brand, your customers, your business. Contact info@datakubo.com for full details.

9. Uptime & SLA

We target 99.5% monthly uptime for the API and dashboard. Planned maintenance is announced in advance. We do not guarantee specific uptime for the trial tier. For SLA guarantees, contact us about enterprise plans.

10. Termination

You may cancel your account at any time with 30 days notice. We may suspend or terminate accounts for non-payment (after a 30-day grace period), terms violations, or fraudulent activity. Upon termination, we provide a full data export and delete your data within 30 days.

11. Limitation of Liability

DataKubo is provided “as is”. To the maximum extent permitted by law, DataKubo is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees you paid in the 3 months preceding the claim.

12. Changes to Terms

We will give 90 days notice for material changes to these terms. Continued use after the notice period constitutes acceptance. Founding and early adopter pricing terms are locked and will not change.

13. Governing Law

These terms are governed by Spanish law. Disputes will be resolved in the courts of Spain. For questions, contact info@datakubo.com.
